Problems encountered in the implementation shall be directly reported to housing security department of the district.

  Detailed Rules of Scheme for Housing of Talents in Huadu District of Guangzhou

  Chapter I GeneralProvisions

  Article 1  These Detailed Rules are established in light of the realities of our district and in accordance with the provisions of the Measures of Guangzhou Municipality for Management of housing for talents (Sui Jian Gui Zi [2019] No.17), the Service Support Scheme of Guangzhou Municipality for High-level Talents (Sui Zu Zi [2017] No.98), the Twenty Six Provisions of Huadu District to Facilitate Business and Help Enterprises (Hua Ban Han [2020] No.1), the Measures of Huadu District for Identification of High-level Talents (Hua Ban Han [2021] No.20) and other documents, in a bid to thoroughly implement the strategy of talent development as priority and establish a support system to promote housing for talents.

  Article 2  These Rules apply to the collection, application, review and approval, allocation, rental and sale, management and other related activities of housing for talents in the district.

  Article 3  The housing of talents mentioned in these Rules refers to those built with the funds raised by the government and allocated by the implementing agency based on an overall planning, in a bid to supply them to high-level talents, inclusive talents and investment promotion talents who meet the conditions.

  The implementing agency refers to the owner of housing for talents and the implementing agency thereof designated by the government.

  High-level talents refer to “international top talents”, “domestic high-end talents” and “district-level high-level talents” identified in accordance withMeasures of Huadu District for Identification of High-level Talents. Specifically, district-level high-level talents include leading talents (teams), high-end talents and excellent reserve talents in Huadu District.

  Inclusive talents refer to middle- and high-level talents who do not meet the identification standards for high-level talents in our district. They include talents introduced by the “Excellent Talent Plan” of Huadu District, talent's green card holders in Guangzhou, excellent introduced talents who are qualified for the housing subsidies of Huadu District, and talents incorporated in the scope of inclusive talents approved by the CPC Huadu District Committee and Huadu District People’s Government.

  Investment promotion talents refer to the talents of enterprises that have signed investment promotion agreements and cooperation agreements with Huadu District People’s Government and investment promotiondepartments.

  Article 4  The talent work leading team of the district shall be responsible for an overall planning of supporting housing for talents in the district.

  The organization department and the human resources and social security department of the district shall be responsible for qualification examination ofhousing for talents in Huadu District.

  The housing security department of the district shall be responsible for formulating the housing policies for talents and fund-raising plans, and shall guide and supervise the implementation of such policies and the management of such housing.

  The planning and natural resources department of the district shall push forward the processing of formalitiesin the planning, land use and registration of housing for talents according to its duties.

  The investment promotion department of the district shall be responsible for taking the lead in the reporting and review ofhousing for enterprise talents that have been clearly defined in concluded agreements, meeting minutes and relevant documents.

  The financial department of the district shall, according to the work needs of functional units and in combination with the financial situation of Huadu District, support the implementation ofmeasures for providing housing fund to talents, guide the budget unit to include the funds required for its work into the departmental budget, and strengthen the supervision of budget implementation and fund use performance.

  The implementing agency shall be responsible forthe collection, allocation, management and other specific work of housing for talents.

  Other relevant departments shallbe cooperative in facilitating the scheme for housing of talents based on their own functions.

  Chapter II Acquisition of HousingResources

  Article 5  The housing for talents mentioned herein can be acquired from governmental housing resources that are built as supporting facilities or newly built in a centralized manner, or acquired by purchasing or renting housing sources in the market, taking over and revitalizing of government-managed stock housing resources, accepting donated housing resources and so on.

  Article 6 For assets that have been transferred as provided by regulations to Guangzhou Huadu Automobile Mall Development Co., Ltd. to serve as governmental housing resources for housing for talents, the said company shall arrange the allocation and management of such housings.

  Chapter III  Allocation Management

  Article 7 The objects to be allocated the housing for talents shall be divided into high-level talents, inclusive talents and investment promotion talents.

  High-level talents, inclusive talents and investment promotion talents are entitled to a set of leasing-based or allocated selling-based housing according to the procedures specified in these Rules; if both the husband and wife of a family meet the application conditions, on a household basis, sucha family shall be entitled to a set of housing for talents within the jurisdiction of Huadu District.

  Article 8  Housing for high-level talents

  1. Leasing-based housing for talents

  (1) Qualified international top talents, domestic high-end talents, Huadu leading talents and Huadu high-end talents can apply for a housing designated for talents of no more than 200 square meters, 180 square meters, 150 square meters and 120 square meters respectively with the rental-free occupancy length of up to 8 years.

  (2) Nobel Prize winners, academicians and other international top talents shall be arranged separately upon the approval of the CPC Huadu District Committee and Huadu District People’s Government.

  2. Gifting-based housing for talents

  International top talents, domestic high-end talents, and Huadu leading talents who meet the conditions for rent-free housingdesignated for talents and have worked in the district for more than 8 years can apply for their respective leasing-based housing to be gifted to them for free.

  3. Allocated selling-based housing for talents

  High-level talents who meet the conditions and have not chosen a rent-free housing can buy a talent-dedicated housing in Huadu District. Specifically:

  (1) International top talents can buy a talent-dedicated housing at 50% of the evaluated price of the commodity housings of the same location and category in the market when such housings for talents are allocated and sold.

  (2) Domestic high-end talents, Huadu leading talents and Huadu high-end talents can buy a housing for talents respectively at 70% of the evaluated price of the commodity housings of the same location and category in the market when such housings for talents are allocated and sold.

  (3) Huadu excellent reserve talents can buy a talent-dedicated housing at 80% of the evaluated price of the commodity housings of the same location and category in the market when such housings for talents are allocated and sold.

  Article 9  Housing for inclusive talents

  Inclusive talents can only apply for renting a housing for talents which will be supplied as per category in accordance with the principle of “combination of the centralized management by specialized departments and the localized administration”. The objects to be supplied with are categorized according to classification of sub-districts, towns and employers. In principle, allocation based on tenancy by the entirety by an employer is adopted. It is implemented according to the Measures of Guangzhou for Management of Talent Apartment.

  Article 10  Housing for investment promotion talents

  1. The selling and allocation security treatment of housing for talents to the beneficiary enterprises (projects) shall be implemented in accordance with the investment promotion agreements, cooperation agreements and other agreements concluded with Huadu District People’s Government and the investment promotion department(s).

  2. Objects in the beneficial enterprises (projects) to be entitled to an allocated selling-based housing for talents shall meet the following conditions at the same time:

  (1) Working or holding a post in an employer in Huadu District, and having signed a labor contract covering over 3 years (included) with the employer or its group;

  (2) Having a full-time bachelor’s degree or above, or an intermediate or higher professional and technical title, a technician or higher professional qualification, or being an enterprise-identified urgently needed professional;

  (3) Conforming to the real estate regulation policies of Huadu District, but having not enjoyed the preferential policies related to house purchase in Huadu District, personally or by his/her spouse.

  3. In principle, talents of beneficial enterprises can buy a talent housing at 70% of the evaluated price of the commodity housings of the same location and category in the market when such housing for talents are allocated and sold.

  Chapter IV Allocation Procedures

  Article 11  Leasing-based housing for talents

  It is implemented with a combination of “centralized handling + normalized handling”. “Centralized handling” is generally implemented by issuing an announcement, and the specific time shall be determined by the housing security department or implementation agency of the district in light of realities. The housing security department of the district has set up a window of housing for talents in the government service center to handle daily applications and realize “normalized handling”. The specific procedures are as follows:

  1. Application and reporting. Qualified applicants shall fill in the Application Form for A Leasing-based Housing for Talents in Huadu District and provide relevant materials and information to submit a written application to his/her employer. The employer shall summarize the application list to be submitted to the housing security department of the district.

  2.Review and disclosure. The housing security department of the district shall submit the summarized materials of high-level talents and inclusive talents applying for a leasing-based housing for talents to the human resources and social security department of the district for preliminary examination. After the materials pass the preliminary examination, the human resources and social security department of the district shall submit the list of high-level talents, inclusive talents and the relevant materials to the organization department (talents office) of the district for review, and the review results shall be disclosed on the official website of Huadu District People’s Government for 5 working days. The organization department (talents office) of the district shall submit the list of disclosed and confirmed review results to the housing security department or implementation agency of the district.

  3. Formulation of an allocation plan. The housing security department or implementing agency of the district shall, in a timely manner, formulate an allocation plan according to the talent qualification review results, available housing resources, state-owned asset review and handling opinions, etc., and shall report the plan to the talent work leading team of the district for approval before the announcement and implementation.

  4. Lottery-based selection of housing.

  (1) International top talents, domestic high-end talents and Huadu leading talents will be subject to arrangements made separately instead of participating in the lottery.

  (2) The housing security department or implementing agency of the district shall carry out the lottery-based selection of housing in the descending order of talent levels according to the summary list (with the habitable area) of housings leased for high-level talents and inclusive talents submitted by the organization department (talents office) of the district.

  ① In case of more qualified applicants than available housings, shortlisted candidates shall be the first group to draw a lottery.

  ② Talents at the same level shall draw their sequence number first, then draw a lottery to select a housing based on their respective sequence number, and finally sign an allocated leasing result confirmation slip upon confirmation of the housing number.

  ③ If an applicant does not participate in the current lottery-based selection of housing, his/her qualification for the current leasing-based housing allocation will be automatically terminated, and such applicant is only allowed to participate in the next lottery. If the applicant gives up again in the next lottery, his/her qualification for leasing-based allocation will be cancelled.

  ④ The lottery-based selection of housing for talents shall be carried out through the on-site notarization conducted by an entrusted notary office, and the whole process of it shall be subject to social supervision of the media and people from all walks of life.

  5. Conclusion of a contract. An applicant shall, within the specified time limit, take his/her ID card and other materials to the implementing agency to sign a lease contract and pay the relevant fees as required. If the applicant fails to sign the lease contract of housing for talents within the time limit after selection of housing, or fails to move in such housing without justified reasons after conclusion of the contract, such applicant shall be deemed to have waived voluntarily his/her current lessee qualification, and shall not apply again within three years from the date of voluntary waiver of the said qualification.

  6. Moving-in procedures. After conclusion of the lease contract of housing for talents, the lessee shall take his/her ID card and other materials to the implementing agency to get the key and go through the moving-in formalities within the specified time limit.

  7. Announcement of allocation results. The housing security department or specific implementing agency of the district shall report the final allocation results to the talent work leading team of the district and announce them to the public on the portal website of Guangzhou Huadu District People’s Government.

  Article 12  Gifting-based housing for talents

  1. Application and reporting. International top talents, domestic high-end talents and Huadu leading talents who are allocated a leasing-based housing for talents respectively and have worked in Huadu District for more than 8 years can apply to the organization department (talents office) of the district for their respective leased housing for talents to be gifted to them for free. The organization department (talents office) of the district shall issue the review results and summarize the confirmed list to the housing security department or implementation agency of the district.

  2. Conclusion of a gifting agreement. The housing security department or implementing agency of the district shall assist the owner of housing for talents to sign a gifting agreement with the applicant.

  3. Housing ownership registration. According to these Rules, the applicant of a gifted talent-dedicated housing shall hold the state-owned asset review and handling opinions issued by the financial department of the district and the gifting agreement to go through the formalities for acceptance of gifting and transfer of ownership with the real estate registration department of the district by following the regulations. The relevant taxes arising from the real estate transfer registration process shall be dealt with in accordance the relevant provisions of the state.

  4. Announcement of allocation results. The housing security department or implementing agency of the district shall report the results of leasing, gifting, transfer and allocation to the talent work leading team of the district and disclose them to the public on the portal website of Guangzhou Huadu District People’s Government.

  Article 13  Allocated selling-based housing for talents

  In principle, it shall be conducted twice a year, respectively in the first and second halves of the year, and an announcement of applications shall be posted by the housing security department or implementing agency of the district on the portal website of Huadu District People’s Government. The specific procedures are as follows:

  1. Application and reporting. Qualified applicants shall fill in the Application Form for A Selling-based Housing for Talents in Huadu District and provide relevant materials and information to submit a written application to his/her employer. The employer shall make a summary to be submitted to the housing security department of the district.

  2. Review and publicity. The housing security department of the district shall submit the summarized materials of applications for an allocated selling-based housing for talents made by high-level talents to the human resources and social security department of the district for preliminary examination of the submitted talent qualifications. After the materials pass the preliminary examination, the human resources and social security department of district shall submit the list of such high-level talents and the relevant materials to the organization department (talents office) of the district for review. The review results shall be publicized on the official website of Huadu District People’s Government for 5 working days. The organization department (talents office) of the district shall submit the list of publicized and confirmed review results to the housing security department or implementation agency of the district.

  3. Formulation of an allocation plan. The housing security department or implementing agency of the district shall, in a timely manner, formulate an allocation plan according to the talent qualification review results, available housing resources, state-owned asset review and handling opinions, and other conditions, and shall report the plan to the talent work leading team of the district for approval before the announcement and implementation.

  4. Lottery-based selection of housing.

  (1) International top talents, domestic high-end talents and Huadu leading talents will be subject to arrangements made separately instead of participating in the lottery.

  (2) The lottery-based selection of housing carried out for Huadu high-end talents and Huadu excellent reserve talents shall be implemented in the descending order of talent levels.

  ① Talents at the same level shall draw their sequence number, and then select a housing based on their respective sequence number.

  ② In case of more qualified applicants than available housings, shortlisted candidates shall be the first group to draw a lottery, and will select a housing based on the sequence their lottery tickets respectively without having to wait in turns.

  ③ An applicant shortlisted by way of lottery shall enter the housing selection zone after being verified, and then shall select a housing within the specified time and determine the specific housing number. He/she may choose a housing from house resources of a lower-level area standard. Afterwards, he/she shall sign an allocated selling result confirmation slip.

  ④ If an applicant does not participate in the current lottery-based selection for housing, his/her qualification for current housing of its kind will be automatically terminated.

  ⑤ The housing number selected by the current lottery is only allowed to be waived once, in which case the applicant shall sign a declaration for wavier of the current lottery; and the applicant is only allowed to participate in the next lottery once. If he/she waive again in the next lottery, his/her qualification for being allocated a selling-based housing will be cancelled.

  ⑥ The lottery-based selection of housing for talents shall be carried out through the on-site notarization conducted by an entrusted notary office, and the whole process of it shall be subject to social supervision in the witness of the media and people from all walks of life.

  5.Conclusion of a contract. The applicant shall, within the specified time limit, bring his/her ID card and other materials to sign a stock housing online contract and its supplementary agreement with the owner (owning unit) of housing for talents, and shall pay the housing payment according to specified requirements. The housing for talents sold via allocation shall be subject to the property ownership transaction restriction(s) within 10 years from the date of conclusion of the sales contract. If the applicant fails to sign the sales contract of housing for talents and its supplementary agreement within the time limit after selection of a housing, or fails to pay the housing payment within the agreed time limit, he/she shall be deemed to have voluntarily waived the current purchase qualification, and shall not apply again within three years from the date of voluntary waiver of such purchase qualification.

  6. Ownership registration. The real estate registration department shall make a note of the property ownership transaction restriction(s) in the real estate ownership certificate. The property ownership transaction restriction(s) shall be automatically lifted when the duration of 10 years since the date of conclusion of such sales contract expires. The relevant taxes arising from the ownership registration process and the certificate handling fees shall be paid in accordance with relevant provisions of the state.

  7. Announcement of allocation results. The housing security department or implementing agency of the district shall report the final allocation results to the talent work leading team of the district and disclose them to the public on the portal website of Huadu District People’s Government of Guangzhou Municipality.

  Article 14  Housings for investment promotion talents

  1. The investment promotion department of the district shall summarize the list of enterprise applicants submitted by each investment promotion subject, and review the purchase qualification of enterprise talents together with the organization department (talents office), the human resources and social security department, the housing security department, the planning and natural resources department and other relevant functional departments of the district; afterwards, the implementing agency shall carry out the allocation.

  2. The implementing agency shall formulate an allocation plan according to the list of purchase qualifications of housing for talents summarized by the investment promotion department of the district, and organize the implementation after the plan has been submitted to and approved by the talent work leading team of the district.

  Chapter V Supervision and Management

  Article 15  The rent standard of leasing-based housing for talents or sales price of the allocated selling-based housing for talents shall be evaluated by a qualified third-party under the entrustment of the housing security department or implementing agency with reference to the rents or sales prices of commodity housings of the same region and same category in the market in the same period

  Article 16  The contract period of leasing-based housing for talents shall be generally 5 years. If an applicant still meets the supply conditions for housing for talents in Huadu District and needs to renew the lease after the contract term expires, he/she shall submit an application for renewal to the owner (owning unit) of housing for talents or the implementing agency 3 months before the expiration of the contract term, and the lease can be renewed only with approval. Talents or enterprises who are entitled to a leasing-based housing for talents shall consciously perform the matters agreed in the contract. If they fail to apply for renewal within the specified period after the expiration of the lease contract, the applicant shall settle relevant expenses and vacate the housing for talents within 60 days after the said expiration.

  Article 17 The allocated selling-based housing for talents in these Rules shall comply with the requirements of the real name registration system, and each talent shall only purchase one set of such housing. The said housing shall not be made available for circulation and turnover or used for mortgage loans (except the housing provident fund used to purchase the said set of housing and the commercial loan used thereto) within 10 years running from the conclusion date of the sales contract.

  Article 18  Any individual or unit who obtains the housing for talents by falsification or cheating, if detected, will be disqualified from the entitlement to the leasing-based or allocated selling-based housing for talents immediately. If the said housing has been rented or sold, the housing security department or implementing agency of the district shall investigate the relevant responsibilities according to law, and such applicant’s application will not be accepted whatsoever within 5 years. In case of a criminal act involved, the case shall be transferred to the judicial organ for handling. The development and reform department of the district shall incorporate relevant dishonest information into Guangzhou Public Credit Information Management System and disclose it to the public.

  Staff ofhousing for talents related units who abuse their power, neglect their duties or engage in malpractices for personal gains shall be investigated for responsibility according to laws and regulations.

  Chapter VI Supplementary Rules

  Article 19  If these Rules are in line with the provisions of the preferential policies for housing for talents of Guangzhou and the district, the support shall be given subject to the highest preferential treatment thereof and not repeated with treatment of the same kind, unless otherwise specified.

  Article 20 These Rules apply to the leasing and selling of housing for talents built and acquired by the government. In principle, the housing for talents built with fund raised by an employer shall be allocated to the qualified employees of the said employer. The specific application, review, approval, allocation and other operation methods may be formulated by the employer with reference to these Rules, and the allocation results shall be reported to the housing security department of the district for the filing.

  Article 21 The Rules shall come into force on the date of promulgation and shall remain valid for 3 years. If there is any discrepancy between other policies related to housing for talents in Huadu District and these Rules, the latter shall prevail. In case of any changes to the relevant laws, regulations or policies or expiration of the valid term of them, they shall be evaluated and revised according to the implementation situation.
